Right of Withdrawal – Digital Products (EU Consumers only)
Consumers residing in the European Union may have a statutory right to withdraw from certain online purchases within 14 days without giving a reason.
The Pretty Little Design Co. primarily provides design services and products intended for commercial publishing purposes. Many clients purchase cover designs, and related products for use in connection with the writing, publication, marketing, and sale of books and associated products.
Where a client purchases services or products primarily for their publishing profession, including for self-publishing or other commercial publishing activities, they may not qualify as a consumer for the purposes of consumer protection legislation, including statutory withdrawal rights. The availability of any statutory right of withdrawal will therefore depend on the status of the purchaser, the nature of the product or service purchased or contracted, and the applicable law.
The Pretty Little Design Co. primarily provides bespoke and personalised design services. Under Article 16(c) of Directive 2011/83/EU and equivalent national legislation, the statutory right of withdrawal does not apply to goods or services that are made to the consumer's specifications or are clearly personalised.
Accordingly, commissions for custom cover designs and other bespoke services are generally exempt from the statutory right of withdrawal.
For digital products supplied electronically, the right to withdraw will be lost once the digital content has begun to be supplied, provided that you have expressly consented to immediate performance and acknowledged that you thereby lose your right to withdraw.
For premade covers, book signing tags, or other products requiring customisation, the right to withdraw may cease once personalisation details have been supplied or work has commenced, where permitted by applicable law.
Prior to commencing work or supplying digital content, The Pretty Little Design Co. will contact you by email where necessary to obtain any required consent and provide confirmation of your order.
Nothing in this policy affects your statutory rights in relation to digital content or services that are faulty, defective, or not as described.
Where a statutory right of withdrawal applies and has not been lost or exempted, you may exercise that right by completing the withdrawal form below or emailing a manual request to theprettylittledesignco@gmail.com. Receipt of your request will be acknowledged by email without undue delay.
